Is Workers' Compensation Required in Kansas?

In Kansas, all employers except those in certain agricultural areas or those with gross annual payroll of less than $20,000 are required to carry worker’s compensation insurance. All payroll, including that of executive officers, in considered in this rule. If the employer is a sole proprietor or a partnership, wages paid to the owners or family members of the owner are not used in the $20,000 figure.

The KS Workers Compensation Market in 2012

The market has been stable for employers in Kansas for some time now. In fact, according to a recent report from the Kansas Division of Workers Compensation, employer’s premiums as a percentage of total wages has actually decreased from 1984 to 2008 which was the most recent year of the report.

In 1984, Kansas employers were paying an average of .90% of total wages toward worker’s compensation premiums. That figure was down to .85% in 2008. There are over 250 insurance companies authorized to quote workers compensation in Kansas, making it an excellent state for employers to buy affordable coverage.

Sole proprietors, LLC members, and partners are statutorily excluded on policies, but they may elect to be included.  If covered, the rating payroll for calculating premium is $37,800 per year.
